When a guy comes to US for education the average age is around 23 - 24 years. MS completed by 25. Most guys at that time have burning desire to do something new and innovative (either in job or starting own business).
And then you lose your libido :). Agreed�. With the delay you lose the golden period in your career and end up at a lower level. Most of the self made millionaires rockstarted young when they had the drive and desire. I still say America gains more than what they lose by delaying GC process. If they hand out GCs faster then who will work for those millionaires and billionaires?.

The other thing i'm trying is your Option 2 - If that succeeds ( before our Indian Brother files lawsuit to stop Porting) I should be good. But that's a dream because my EB3-I 140 is stuck at Nebraska - once that comes out of that hell , i should be going on full steam. It wont be difficult to find a Job with my skillset who will sponsor me a new PERM and new EB2 140 and port my Lousy Eb3 140 Priority Date.
I am exactly in the same situation. Sometimes I feel that I should just dump the EB3 application (PD: 12/04) and start a brand new EB2. Maybe the EB2 PD of say 12/08 will end up to be better than EB3 12/04.

Ok then, why did you come to America to study at Duke? Why did you spend all this money? The reason our people invest crores of rupees in American education is that it is better.
You people seem to be too nationalistic. Even with the comments about quotas. Affiirmative action with 52% of all seats being reserved based on caste? You call this fair?
I dont think anyone is arguing that american schools are not good enough.......they certainly are - specially with the kind of tuition fees people pay to get into these schools. Besides - people coming here for education does not necessarily mean its better - lot of people come here for the international exposure - lot of good students from around the world do indeed congregate here for education - combination of good schools, openness, english as common language....all these have contributed to the historical greatness of america - does not make your motherland any worse!
Look at quotas as a way to bring in factors other than just your score in a standardized examination.......in India that factor might be caste - here it might be affirmative action in favor of some sections of society and other subjective factors like essays, letters recommendation, the fact that you were a cheerleader in high school etc.....look, i am not saying quotas is a great system - but all i am saying is that there are shortcomings in selection systems in schools around the world not just India.

How come observations made over years on 100's to 1000's of students are "unsubstantiated"? Of course you may want not to believe me; that is your prerogative, and so is writing my own experience mine.
raysaikat - You must be kidding by trying to prove that you have taught 1000s of Anna/Osmania University students & number of them are bad as you described. You started in 100s & are now talking about thousands and I am sure if this argument continues you would go to even higher numbers just for the heck of proving your point. After all, its a matter of pressing few keys on your keyboard....but what credibility does it has when there is no way to validate??
May be, as "NKR" pointed out, you have some bad impression about the Univs in certain region of India - looking at the list you provided!! Otherwise - Anna university is considered to be a top rated institute in south india esp., TN state. Osmania is also a very decent one (esp in Engg/comp sc). Both these universities are very famous for their ability to attract a lot of recruiters (All top indian companies + many MNCs as well). And here on this board, you just rule those out with a single word - Crappy!!

They are working overtime for it, hopefully 24 hours as well. This is my fear even before this announcement that visa numbers be wasted again.
Maybe we can volunteer to adjudicate each of our own case...lol!

I dont mind getting Red Dots, But please, for god's sake. Stop doing this fruitless campaign. Do you guys think Giving a Clock or sending flowers solved earlier problems. Enough of this Gandhiian ways. This country is not good for people like Gandhi. May be Flower campaign got noticed and created a whole new experience for the USCIS, but i dont think it really helped them do anything in our favor. Already, folks here are wasting their money, year after year, on their EADs and APs for them and their family. Just think for a second guys, It costs us 1000 $ to maintain status on AOS and visit our family and this is going on indefinitely for our years now. USCIS/Congress does not want to do anything about this, They are happy to get the revenue. Even if you think a minimum of 200,000 people spending 1000 $ an year, it is 200,000,000 $. Iam not even considering the amount they spent on other things like H1B extension, H4s..... Just think about the Dollars they are making on this Green Card SCAM. Accept it or not, it is indirectly affecting our lives, even though, GC is not really important for lot of folks. Iam one such person, I have a good client and a decent employer and iam with the same folks for 9 years and they are happy extending my H1b at their cost. But still, this whole GC game, is sometimes disturbing. They are playing with our emotions and our loved ones. So, GUYS we need to take a bigger and bolder step. To me, Calling people, sending flowers and letters explaining the situation makes no sense. Do you think, those guys dont really know about our situation. Let us a make a bold move. We are 70,000 folks just here in ImmigrationVoice. Let us compile a letter,that pushes USCIS/Congress on improving the condition. As long as they get those EXTRA Dollars, i dont think anything is going to happen. Even if they remove the provision to apply for GC while on H1B, it is good for us, for we will know that in advance and can plan on shaping our future better, instead of this false promise and emotional torture. I think even AILA or other Lawyers are useless. They dont want to do anything for us. All they do is, interpret the LAW , and explain us in the way we can understand. They dont take steps to fight for the justice. All they care is the money. So let us make our point clear to USCIS, we dont want to waste money on EADs and APs and H1B extensions. To me, it should be free of cost, since it is their problem that they dont work efficiently. Why should we pay 1000s of dollars for their inefficiency. let us all 70,000 work together in sending a letter to USCIS or Congress that We are not willing to spend any more money on the GC knowing that we are not going to get it anyway. Unless, we do something like this, the real impact of our situation will never get noticed. Again, our main aim should be to let them know about our situation and not just that IV is a group that will send flowers, to express its presence.

Guys please enroll for recurring contributions. Its for our own good. Please dont sit under the misconception that since we applied for 485 and we get EAD we might be ok. you are not safe until you have the green card in your hand. durbin, grasley, ron hira are out there to get you, I wont be surprised if they come after EAD once they are done with H1. Please contribute to IV so that we can work on the next leg on the process, be it SKIL or visa number recapture or whatever comes but to do that IV needs money, please contribute so that we can build on the momentum. Junior members, news members you are the new blood please come forward and contribute. To existing members please think about increasing the recurring contribution amount.

Entire world is turning up against immigration. It is beyond individual/group control to lobby for changes in that area.
It is on the threshold of the time. Right now we as individuals still can make a decision to continue to be in US and wait it out or go back to our home country.
But if this trend continues, I am afraid, some new law will make that decision for us to send us all back. It is just around the corner. Worst part is we can't do a thing about that.
So want to blame anyone, blame your politicians of your native country for creating such a mess that people wanted to move to a different country.

Education system is detoriating day by day because of privatization, private institutions only look for profit and dont care mostly for their students. Fortunately they have billion people to get customers. Our engineers are mostly unemployable
Property values are rising to extreme level beyond affordability of common man. Poverty rate is increasing day by day. Agriculture is detoriating and we are not a manufactuting masters. Our engineers are getting poor in quality day by day and scientist get frustated every day because of injust system so try to migrate every where else. We can never survive as country creating softwares or answering calls for long time. It might serve us for short period.
Morality. Corruption, attitude of peoples and so-called social net work (which is even more selfish then US) are even hard to compare with other countries where relations and systems are more open and frank. In our home country on surface every thing looks good but if you try to look below it is hard to say how supefecious it is.
so in short if we are hear only because we wanted GC, then we should leave in next flight to home. But if you have seen any other advantages of being here then hangin, GC will come. Dont wait for GC every day, just live your life and enjoy it to full extent.

The reply that Ombudsman office wrote on Sep 11th came to my hand just today Oct 7th - looks like they have backlog in mailing letters as well.
Anyway - the summary of the letter is similar to he email discussion few days back ( as below ) ... USCIS should get back to me in 45 days i.e end of Oct 08
Today morning Ombudsman replied to my 2nd email ( as below) and confirmed my address - they said that a reply has been sent to me on Sep 11th for my 7001.
Then i sent a return email saying i didn't receive any reply till today Oct 2nd and he further emailed me back saying that USCIS must give me a response by Oct 30th on my Pending I-140. Keeping fingers crossed - will post here if i see any LUD or activity in my I-140 in the next 3 weeks time.

This eliminates all the issues that H1Bs face today when applying for a GC. Employer portability, Visa retrogression etc ( and not to mention employer manipulation of H1Bs workers in delaying to file GCs ) are applied in fairness to everyone. This takes the fear out of H1B workers to change jobs at will without regard to negative impact on their pending GC applications..
Way to go.. Why can't IV propose to add this one liner to any of the impending amendments or find another lawmaker to support this which can alleviate most issues faced by H1Bs today.

I have finished calling all the republicans from the list. here are my
experiences. Most senator aides were patient and took down messages, i
have listed the different ones.
Senator Judd Gregg (R-New Hampshire) : does support high skilled
provisions...*yay*
Senator Michael Enzi (R-Wyoming) : aide was very patient and chatted
abt legal immigration reform and took name, number, zip , msg to pass
to senator.
Senator Lindsey Graham (R-South Carolina) : went to vm twice. left vm
Senator John Cornyn (R-Texas) : aide not very patient. asked to call
my state senator.
Senator John Kyl (R-Texas) : aide was very patient, and understanding,
and had a chat about current immigration scenario. Senator Kyl is
supportive of legal immigration, he intro/supported one bill for us in
2007 but it failed to pass. He said that the senate politics is not
letting high skilled immigration reform pass. he does not support
amnesty, he wants border secured, etc before fixing broken legal
system

Senator John Cornyn (R-Texas) : aide not very patient. asked to call
my state senator.
Senator John Kyl (R-Texas) : aide was very patient, and understanding,
and had a chat about current immigration scenario. Senator Kyl is
supportive of legal immigration, he intro/supported one bill for us in
2007 but it failed to pass. He said that the senate politics is not
letting high skilled immigration reform pass. he does not support
amnesty, he wants border secured, etc before fixing broken legal
system
