    i am EB3 apr or may 2002 PD. In late 2005 i had asked my lawyer about switching to EB2 and she told the company that it would be a waste of money because our PD was 'so close' to being current. its 2008 and we are still 'so close' ;). i should have gone ahead and switched, now she says the same thing but i dont plan to listen. at the most i loose 6-9k...

    i guess each one should take a decision on his/her own situation, without over analyzing. I agree with you that people with PDs 2003 and beyond should certianly consider switching.

    PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.

    Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.

    PD Nov 2002 and beyond : Have to actively consider switching to EB2. Myself being in this range, I am doing the leg work and waiting to hear on what happens to the recapture bill. If it does not happen then these PD's should switch if they can and qualify.

    Instead of being jealous towards EB2 bonanza , I think EB3 applicants should make use of this Eb3->EB2 conversion option and participate in the bonanza.

    Yes, it costs additional 9K . Consider that the price of the ill advised decision to go in for Eb3 to begin with.

    An opportunity to get past this GC mess and start realizing your dreams on both personal and professional front.

    you dont need to pay anymore money for EAD when you apply in future. this is what my attorney said. Thats why USCIS fees is very high and its one time fess for EAD and AP.

    Expectations are so high. Unless they workout compromise it may take long time to pass CIR. The risk is democrats want more relaxed CIR than 2006 form. We have to see how republicans will react for that. Also How skill bill form this year? Depends on that only CIR fate will be decided

    There's no doubt CIR is going to be brought in this year. How much of it or any of it will get passed, is the issue. Congress, as last year is determined to amalgamate us with the illegals so they can freely oppose the bill and indirectly kill both kind of immigration. I think we should put all our resources towards lobbying and make as many friends on the hill as possible.

    rockstart, what was the issue with Advance Parole, can you elaborate?

    London does not accept travellers with AP. So Virgin Guys had to turn me back from their counter. I was sure about Qatar having no issues about AP so I went back to Continental and said I need you guys to put me on Qatar and thats what they did.

    This is certainly good news for many. However the skeptic in me is feeling very uneasy. Why did they suddenly open the flood gates? Did they purposely create a backlog and then increase the fees (double the fees) just in time? Are we going to face other issues down the line after applying for 485?

    I guess for now, we will just celebrate and try to get our 485 applications in before July 31st. After that it is a wait and watch situation.

    Congratulations to all who got through this first hurdle.


    If you overanalyze any situation, for the matter even, "why come to work?", one will always find consipiracy :)..

    I say lets not overanalyze this and lets celebrate and keep our fingers crossed for avoiding any further issues !!..

    i am pretty sure, there wont be any fee for next 1 year, for the guys who got 1yr EAD. but, third year u pay again $340 for 2 more years. bottomline,$340 is for 2 years of EAD. otherwise there will another law suit from AILA.

    i think the reason for super-quick approval is not that they want milk more money. they must have approved ur EAD before USCIS released formal 2 yr EAD notification. and not many people filed for renewal at that time, due to 120 days rule.

    i myself delayed, filing EAD renewal, soon as i heard the news about 2 yr EAD will be effective from Jun30th. :-)

    similary, i converted my Apr'07 I-140 to PP on Jun18th,'07 and got it approved on Jun26th,'07, few days before they stopped PP :-)

    I would not recommend Joe Kirkwood. Went to see him in person. I drove from San Jose to San Deigo almost 8-9 hrs and tried to see him. I asked for 5 mins of his time and he declined. His receptionist was also surprised. I am not sure how he would have handled my case. I decided not to go with someone who's too busy to spare 5 mins for someone who drove one day to see him.

    Thanks for setting this up. When I used to see this tool on other sites like numbersusa, I was wondering how IV can use similar technology tools. Luckily, technology makes the same set of tools available to all the parties working on the issue and allows them to play on the same playing field.

    Unfortunately I cannot attend DC effort due to earlier commitments but I will contact my key state senators (newly elected moderate republican key for this effort) in summer and is contributing monetarily to IV for DC effort and can help anyone for tickets/housing for DC effort.

    Kudos to IV for setting this up. Great job!

    My 'Employer #2' H1B I-94 and 'Employer X' H1B I-94 numbers matches with I-94 number that I got at 'POE'.
    Receipt Data is July-2006 for 'Employer X' H1B.
    ......

    Could you please provide following info
    1. I-797 dates for Employer 2 and X
    2. Last Date of entry in USA
    3. Date when I-485 was filed

    I-94 number being same does not mean much. One can have same I-94 number for COS from H1 to F1. On the other hand, one can have different I-94 with H-1B transfer. Typically, H-1B transfer means new H-1B petition for the beneficiary who is/was in H-1B status and is not subject to H-1 cap.

    If beneficiary's initial H-1B was counted against cap in last 6 years, then subsequent H-1B petitions are not subject to cap and usually referred as H-1B transfers.

    Guys this is great, we can all ask our friends and colleagues to sign letters and we can all secure them by paying for the stamps ourselves. I am not sure my husband knows I have shares in the post office now, but I think he would whole-heartedly support it, and he supports what I am doing!

    Guys who got NOID/Denied 485, quick question.

    Looking back, do you think it was worth making the job move using AC21? Is it really worth the time, money, anxiety, sleepless nights that you go through during NOID-MTR?

    For people getting layed off, they have no choice but to use AC21, but for rest of us, why not continue with the job you are currently in and let the GC take its turn rather than risking it?

    PS: I am in US for past 5 yrs with May06 PD. I am just trying to get an opinion here, so don't flame on me. I was comtemplating on using AC21 but reading all the NOID stories, i am bit hesitent now.

    Well - depends on how you perceive it. A few days of anxiety is better than working with same salary/same job for years? Most of my friends are scared to use AC21. They are just shit scared, they do not want ANYTHING to happen to their Green Card - they did not join IV because they are scared that something will happen to their GC petition.

    Knowledge is power, ignorance is bliss. I used AC21 because I was with desi employer - though our relationships were good, as the client filed for chapter 11, my desi employer who has a poor accounting system figured out that there were a lot of invoices unpaid which he never bothered to follow up and lost a lot of money and rubbed everything on me. So it was a good time for me to get out of such mess as I already finished 180 days after filing 485 and as such I had been doing my own marketing, negotiating my own billing rate, and always billable so I utilized this opportunity to get into a more stable job which is decent paying.

    I talked to various lawyers and was aware that AC21 has some risks involved but everything can be sorted out. I weighed options, though I could stay with the company, I moved on.

    So it is your choice.

    It's true that Democrats tend to be pro immigrants a bit. However, most of their backers are labor unions, which obviously don't want to see any more labor here, legal or illegal.

    How will these forces play out on the floor is anybody's guess. We've seen how a Republican congress works. Let's see how a democratic congress will. I'm just a little bit hopeful... same as 12 monts ago... not more... not less.

    the good point is that lot of people till end 2003 got their GC's in states like georgia. I guess many people in states like california must have gone to EB2 or gone back to their countries. lot of companies closed their shops but at the same time there was lot of labor substitution. I guess at this point EB3 - (I) cannot do much except pray and sleep(and hope one of the advisors to the president / congressmen tell them that more or speedy legal immigration actually helps US (in housing / SSN mess / medicare / tech innovation / outsourcing etc etc).
    I was talking to a manager (naturalized citizen) of a top company and he said the same ..baby boomers are /will be retiring and you will see more old people in usa rather than youngsters - this is the most important advantage that countries like china and India have (young population).

    as EB2(I) and world wide dates starts to move ahead - I guess future support to IV (or any campaigns) would continue to diminish

    have you guys lost the ability to think and read...
    It is USCIS that decides the categories and it is they who say that EB1 is more skilled and valuable than other categories
    Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is... and that was my point .... if the value placed on the job is higher that job...

    If things make you sick .... there is a fix for it .... go to a doctor ...
    But truly... I do believe you are sick, inability to coherently digest a discussion and think is a serious anomaly and you should get it checked out...

    Herez the qualifying criteria for various EB categories.

    FIRST PREFERENCE Includes:

    Intra-Company Transfers - Executive or Managers
    Outstanding Professors and Researchers
    "Extraordinary Ability" in the sciences, arts, education, Business and athletics
    Note: Categories 1 & 2 do not require a labor certification7 Category 3 does not require a labor certification or offer of employment.
    SECOND PREFERENCE Includes:

    Professionals with advanced degrees
    Aliens of "Exceptional Ability" in the sciences, arts or business
    Note: both categories require an offer of employment and a labor certification unless a "National Interest Waiver" is obtained.
    THIRD PREFERENCE Includes:

    Professionals with bachelor's degrees
    Skilled workers filing positions requiring at least two years of training and experience
    other workers.

    Every category includes skilled professionals.

    The classification is based on education/priority/years of exp.

    We all have the option to apply for a "better" category, but we choose not to because either we don't have supporting documents or our employer refused to do so.

    We should stop infighting and focus on bigger issues at hand.

    Hi,
    1. I filed for my I-485 in July 2007 with the old fee. This included AP & EAD
    2. AP and EAD were renewed in 2008 Sept, with new fee for both of these
    3. AP is up for renewal, so is it free for me,or do I need to pay $305 again?

    My question arises, since I assumed that the "free renewal" is for anyone who pays the new fee "once" for the EAD/AP.

    Anyone who knows about this thing?

    After all of that if your pay is greater than 75K and if you file separately you will not be getting stimulus package. This was the news i got confirmed from IRS over phone.

    This is very old news dude....:D:D
