never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?

I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!

Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.
I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!

A lot of us are busy getting our questions answered for filing our I-485. It is a sincere request to all members to please call ALL 100 Senators expressing your opposition to Menendez amendment SA#1317. This is an extremely important Action Item and it is time sensitive matter. Every voice and every call counts. We have all asked/answered many questions about the recent I-485 filing wave and we may have more unanswered questions that we would like to be answered right now. However, please understand that Senate proceedings, cloture vote and Menendez Amendment will govern the future shape of the entire green card numbers and the entire process. I got laid off with a pending I-140 filed July 2006 along with I-485. I was told that as soon as those docs are filed my H1B becomes invalid. True? I still have an approved H1B receipt from another company valid thru Feb 2008. Can I still use it? Thank you.
You are pretty much safe to look for another job using AC-21. But make sure the job description is the same as your previous work (the company that did your concurrent I140/485 filing. You need to consult a lawyer for the AC-21 process.

Can you give us some more details about the call to get receipt number?
One of my friend called but they said they can only give I-140 Receipt no to employer.
I called USCIS today and they asked my name and date of birth and they gave me my Receipt Number for I-140.
My I-140 was recieved on July 16th and they generated a receipt notice and have sent me...I shud probably recieve it by this week.
Hope u all also get it soon...

for all those who complain, and say the IV core doesn't do anything. the very reason you are expression your opinions, and most everyone getting advise is because the IV core took pains to set up this forum. It takes great deal of effort, time, money, sacrifice to do something productive and useful for the masses.
If you are too much worried or frustrated with the IV core not sharing info with you, why don't you take the pain of starting a forum of your own, and see how many people will join that. You will understand what all pain you will go through.
Personally I am a donor, because I understand the sacrifice people make to get this thing going. I know nobody is making money out of my donation 'coz they'll be in deep trouble for doing that. And I am not going to complain because I am not being informed of all the actions going behind the scene. I trust the core for doing the right thing which is beneficial to all. There are few core members who have already got the GCs but are still working on this effort.
So my humble advise is "pls don't complain...nobody is under any compulsion to contribute or do anything. The request is out there for all but it's upto you to act".

I think lot of people feeling that it is very difficult to pass Senate version CIR(May be they will pass house version now and Senate version later).
That might be reason for Skil bill. But any bill which has permanent increase in immigration will face a big opposition and delay of few weeks to few months to pass. In past 2000 the h1 increase to 195k was passed because that was temporary and eventually Cap was back to 65k. Similarly for GC unused other country quota was used to India and China. So everyone got a relief without much oppostion. Beacuse they were able to convince all congress members that no change in Cap of immigration. But skil bill is having permanent increase of GC and H1 and also exemptions will increase further immigration numbers. Though it is a permanent solution to resolve retrogession of pd it will face big oppostion from anti immigrants.

Great points. Is it possible for the primary applicant to continue on H1 and the secondary/dependant applicant apply for EAD?
I have the same issue now , my h1b 6 years end in 2007 december , h1 extensions are granted only if the labor is pending for more than a year or dates are not current for 485 ...
So I guess we are better of being on EAD rather than on H1B because of all the bad publicity associated with it now a days and kind of restrictions they are planning to bring on H1B.
Even the dual intent is gonna be removed if the bill passes in its current form. Looks like senate is trying revive that unwanted baby called CIR ....
Even if CIR fails , the chances of enacting 1035 on its are very high So in a nutshell its better to get to the 485 queue and wait so that they will start some preprocessing on 485 applications after year at least.
All of us know that dates will move back and we have to get ready for that ..

When you say these are the " ONLY REASONS", you should think twice. If your wife delivered baby on that day or if you had back surgery a week ago probably you would not be been in DC for the rally. So please dont generalize anything.I am not sure if the most efficient way to motivate people is to write bunch of threads with the words like the four you used many times.

you are right. many people had very genuine reasons. personally i was glad to represent them in DC. even some very committed volunteers could not make it. i do not think chandu means to generalize. he is venting his own frustrations at the very substantial number of members who simply choose not to participate...in anything...let alone a rally...

Who said EB3 India will not forward next year? Did DOS say that? An individual lawyer is not Dept. Of State. I would like to see a written proof from DOS saying this so that we can plan ahead.
There were many naysayers for the July 2007 bulletin. But IV was able to get it current again. So stop believing in predictions and believe in yourself.

Pappu, I bet you must be in a better position than me to know (not to decide, ofcourse) about the plight of this bill. I would be surprised if you deny.

More good news: China EB3 had almost caught up with worldwide EB3 and is likely to do so next year;
The bad news: when visa numbers become available again, India EB3 is going to be back where it was almost a year ago and it is not likely to move forward much in the next fiscal year.
More bad news: 40% to 45% of the entire backlog is Indian EB2 and EB3.
And barring, July 2007, EB3 I has moved only inches in the last 2-3 years and that's how much it would move in the next 2-3 years (and that's assuming a similar efficiency pattern that USCIS exhibited this year).

Those 22,000 members, its a simple letter. Just grab a template and write it. IV has been working hard for us. A simple act of mailing that letter would help everyone here a lot.

What happens if I get my EAD after 180 days of concurrent filing i-140 & i-485, and my employer no longer has a vacancy for me. Can I start at another job or do I have to refile the i-140. (I'm not presently working for the company yet)
