Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.
When an eb2 complains about not having ead his concerns are valid and nothing else is more important on IV thean that

U know what, actually we all eb2 guys are very sad about the eb3 plight. And if we do get a visa number, we will request uscis to dsitribute it to eb3 category. does this make u guys happy now ???
why dont u think abt those guys, who filed in eb3 earlier, knew that the trouble is brewing, and switched jobs to be able to file under eb2. why you guys dint do that so far. dont blame uscis. they were, the are and they will remain a mystery for ever. its not our birthright. if DOS thinks they need more research grads, they will keep eb1 current, if they need more exp guys, they will improve the b2 category. And if they need more frsh grads, they will come to eb3. And if some exp person is stuck in eb3, he himself is to be blamed. dont blame anyone else for your ignorance of GC rules then.
So fact is we all are under DOS/USCIS mercy. 2 years back it was eb3 turn, now it is eb2 turn. Unfortunately no is blaming why ebI is always current. if that reason you can digest, then you should have the gall to digest this one too.
Ok, this thread is degenerating. I had told nothing against EB2 other than saying that we cant be happy for anyone given our situation. We are not asking for any pity, or asking for you to be sad for us. You being (or anyone) sad for us will not make us happy. You "asking USCIS to give us your numbers" will not make us happy either.
So please stop saying things which is obviously trying to make light of our situation. I see that even though most EB3ers are talking about why the law changed and if it is reasonable for the law to have been reinterpreted, *most* EB2s are responding at a personal level.
BTW: DoS does not make the determination if they want more or less of Eb1, Eb2, and Eb3s. The law does that. Also note that it wants all 3 categories in equal quantities -- when there is sufficient demand.

Mea Culpa. I'm the culprit here :).
I requested for the meeting close to weekend. It turned out some other new chapters were also in the same boat. Core put us together in the same call, which helped, as our issues are more or less the same. Timing was inconvenient for cagedcactus due to personal reasons. Yet he participated (which we should appreciate). Some veterans also nearly-missed the call as everything got finalized a few hours before it.
Regarding nearby states, we can try to accomodate Indiana (IN) and Ohio (OH), and my be Wisconsin (WI), the states that border Michigan, that is if they already don't have an active chapter.
I missed it, not aware of it, not sure why. I am glad to see this chapter grow. There was a time where we were searching for folks with torchlights. Thanks to Chintu, walking_dude, cagedcactus, bestin and all others who are now making this happen.
I have a very close friend in Michigan, and asked him to join, but he talks about all hardships, about his HR manager, about his company, about his lawyer, about everything except IV stuff. I am sure there are many more people here doing the same thing. We have to motivate folks to come forward. We cannot afford to have people who are inactive.
Good luck to you all, try to merge folks from nearby states if they are still not organized until they get organized.

I started with a 20$ recurring contribution and now I contribute 100$. I am not going to wait for the Google Ads to show up on IV and I think every penny I contribute for IV is money well spent for a cause I believe in. At the end of the day I am helping myself and I am also with a group of 23,000. I belive together we can achieve our goals. Please come forward to contribute
http://immigrationvoice.org/forum/showthread.php?t=15493
Actually I made mistake in my math,
$20 (2% of $1000 monthly bill) * 2k ( 10% of 20k IV members) = 40K per month
I guess 10% people with $1000 monthly credit card bill is not too optimistic.. is it?
One simple way to measure this is, lets have poll. ( how do you create poll?) I have never done it before.
poll choice should be
Your preference to contribute to IV
Choices are
1) I prefer to contribute $10/20 cash monthly
2) I prefer to use IV branded credit card, Let CC company pay 2% of my cc bill every month.
3) I prefer Google ads on IV website...I promise to click on 10 ads every day ;)
One important question is, does IV loose any charitable(non-profilt) status by issuing a CC?

Just being paranoid, but is 797 the number for the "receipt notice" as well as notice of action? I know that when H1 or 140 is decided, the notice of action form is called 797. I know that the USCIS seems pretty clear in the FAQ, but just wanted to confirm that a receipt is also called 797

com 'on. H4 process is known as Dependent Visa. Let H4 prove the Credentials and Get H1 ..........
Yeah , For sure we all knew H4 is a dependant visa.
So we are denied work permit but we are not denied the freedom to ask or even lobby for changes in the Law.
But we didn't know that we are going to go through a painful process called Labor Certification which in our case is pending for more than 1675
days........
If all went well an H4 Spouse, who decides to get married to an H1B, would have faced an average of three year break in her career before she recieves her EAD. Now due to the huge backlog in Labor cert and the next awaiting Retrogression We are facing huge gaps of 7 to 10 yrs, which is almost unrecoverable, So IV Core pls understand and consider our issues as Real.
And getiing an H1 in fields other than Software is tough, but that does not mean that the person is incapable. An electrical engineer who had worked for 4 years previously in india in a well reputed firm was unable to get an H1b.
A Request to moderator : Please moderate posts which contain deregatory comments and words towards H4 Spouses.
Thanks

To the major headache we will be facing. Economy.
It is going to get nasty and there will be massive layoffs. We will have to hope for a quick recovery. Just today lehman, then washington mutual...who knows what is in store next. I heard that car companies are asking for bailouts. We got to end this war and spend the money here on improving the economy. All this money wasted in war is draining the economy...

That is right. But same country quota is there in EB system also. So in point system also 80% of people will get same quality of people as current system. But advantage is process delay will be eliminated.
The points system will likely result in significant deterioration in the quality of EB immigrants.
The biggest flaw of the point system as it is currently structured is that people may be able to get a green card even if they are unemployable in the US. No one knows what fraction of green cards granted under the points system would end up going to these types of cases.
As it stands today, 100% of all people admitted under the EB categories are assured of decent employment when they are granted a green card. Why should we move to a system that permits people to come in based on paper qualifications, work for low wage jobs and then after 5 years claim welfare benefits?

I do not see anywhere in the legislation where it says that EB1 is "more skilled and valuable" that EB2 and so on. What it does say is that the various categories require a certain amount of education and hence my point! I am not insecure but I AM frustrated at your arrogance. Look before you leap and read the Immigration Act!!!!
You betray your own post .... forget the INA .... all you have to do is read the visa bulletin ... read just the 1st page.... thats all you have to do ...
The Employment categories are basically termed as "EMPLOYMENT-BASED PREFERENCES"
Surely you must be intelligent enough to reach the same conclusion regarding USCIS preferences regarding categories that I did.

Ok, firstly, if you are really honest about your feelings, no one is really happy for another unless what the other has done is useful to you. You can wax your eloquence with claims to contrary, but you know it is true. So stop this pretensions.
Ok, you want a constructive suggestion? Rat on everyone who is doing fake jobs, is a body-shopee, bought his GC etc. That should get rid of at least 20-30% (conservative numbers). How many will support it? I guess not many.
How about asking USCIS to make the priority date of the substituted applications to be the day 140 is filed? Any takers there? I guess not.
And then people have the gall to tell us to be happy for Eb2ers, and that we are jealous.
PS: I realize that substitution is no longer possible, I mean to ask USCIS to retroactively apply the priority dates for such cases.

Yes. Completely agreed.
I've an idea that I want to discuss at the Meet. It will not only help us show the World how much we contribute (real figures), but also get our group (state chapter) legitimacy in the eyes of Lawmakers. It also might get us some media attention. This and other ideas will be Exclusively premiered at the Meeting. So anybody interested, be there.
Anybody with great ideas - FIFO for GCs, Earned GCs (based on years in US) included, be there at the meet. We'll surely forward these ideas to the Core. If there's a great demand for these ideas at the grassroots, Core'll surely include these as their top agenda. So be there and share your ideas. Ideas will be put to vote and passed on to the Team IV. It's a great opportunity to network with like-minded individuals and push for your ideas.
You are being given a rare and valuable opportunity here. Use it! Don't crib later on IV forums that IV doesn't care. [ I'll be there, for sure, to ask you - Did you care about your state chapter meetings? If Not, why should we care for you?]
PS : Bestin, same here. Lets build a strong network in Michigan and succeed together.
Guys,
We also need to make the public aware what we contribute to the society. Not only our jobs, but also how we contribute to ssn, work without unemployment benefits (when compared to citizens),how much taxes we pay, etcs tatus of h4 dependents without driving licence and with all these stress we also do our job with a smile isnt?WE DEFINITELY NEED TO OVERCOME THE PUBLIC OPINION THAT WE ARE JUST HERE TO TAKEAWAY JOBS.
Rather than mentioning it as our right,we need to make people aware of how we contribute and why we deserve a green card.;)
My 2 cents.
BTB,nice taking to u over phone WD.

The intent of this thread is good. There are however practical considerations.
Many of us are from India. In the era pre opening up its economy, we had many well educated folks unable to get jobs there. The socialist strangle was such that highly educated people had no suitable jobs and private enterprise was actively discouraged. Many sought economic and professional refuge in more capitalist economies and to some extent we are still seeing the spillover from the policies of that era, with an excess supply of human skilled capital there and opportunities still not able to spread to the whole economy/population.
The reason I am saying all this is, investing in skills like masters etc is generally a good thing, but not always. In fact there are many studies to prove this point, some demonstrate that too much education is a negative predictor of economic success.
In our situation, capital is important, whereever we end up. Since in a capitalist model money works for you, and obviously if you have enough of it then you can spend your time doing other things, charity work or whatever warms your heart. Doing an MBA or any other higher education is very expensive in america. It is an investment. If you end up here, it will perhaps turn out to be a good investment, otherwise it will be of limited use to us especially in India, especially if a global recession hits.
Pessimistic you say, lets reserve judgement on that and consider all of the geo political issues going on right now.
If that is so the capital preserved by not doing an MBA in a top ten school which I estimate to be about 60-70K if I am not mistaken might be put to another use.
What do you guys think about this line of argument.
