The problem of contacting media with "stories" is that you don't want people who are just hanging by a thread; just trying to stay in status and having all sorts of hardship because they want to stay. It feeds into the fact that there are a lot of people here which the country doesn't need. Discussing layoffs or threats of layoffs or employer abusing, etc., feeds into the perception from an outside person that there are too many people here not doing specialized work that an American is not able to do.
Regarding Berry. I haven't gone to programmersguild web-site in a long time but the point that they seem to always bring up which seems to really bother them is that an American lost their job after training an h-1b person who was a cheaper option or an American lost their job because they had to train an L-1 worker who would then take the job offshore. He also points to h-1b companies who don't pay very much (information taken from LCA's which is public information).
Fortunately for the skilled immigrants; many members of congress/senate are business leaders themselves. Everyday there is a merger and job elimintions where one person has to train another who is getting their job cut. After all when Bank One merged with JP Morgan, there were a lot of people who had to train others and the trainer eventually lost their job. This is normal to business and not specific to people on work visas. Therefore, they don't have much merit to this argument. It is a fact of everyday business that if a job can be done by a person with one to two years of experience then they will replace a person who has been doing it for 10 years. the person with 10 years of experience could have pretty substantial pay package because those 4 to 5% increases over 10 years can add up. If a person is overpaid for a job that doesn't require much experience then they are pretty much dead weight and are discarded. This is not specific to immigrants but has been going on for many, many years in this country. Therefore, although their arguments at face value may have some merit to them; the business leaders, members of congress/senate are too smart because they themselves have done this at companies they may have been associated with and those companies probably didn't have much immigrants working there.
Unfortunately, on paper it does look like the bodyshops are paying very low when looking at LCA's. However, we all know that what is listed on the LCA; in no way has any reality to the total compensation that a person is getting paid. If people are working on ratio which most people do convert to; their billing rate on the low end would be $50 ($100,000 per year) which would probably work out to $80,000. However, the LCA might only show a salary of $50K (people take per diems as the rest or save it for a rainy day).

This is exactly what I do after a similar experience in 2003. I always discourage my friends and family from flying with Air France though I disagree with the statement about 'European carriers'. I have flow KLM & Swiss and they are very good airlines.
I think the best airlines are US airlines unless you are flying Delta.
I agree Swiss is good, and so is KLM. The issue is with the indian staff that they have in india. But I have no issues with them or Air India, cos atleast they are indian.
but I would never let a european/us carrier treat me like dirt.
And likewise, I dont have Air France even as an option. regardless of whether they are cheap or not.
I know I can live without them, and would only fly with them if they were the last airline which can fly airplanes.

My Own Case:-> I work for a multibillion dollar telecom company and joined this company almost 15 mos ago with a promise that they would start my GC immediately. Till Now, they have not yet file my labor. Their lawfirm is Larrabee http://www.larrabee.com/ in sanDiego. I don't have much experience with them as my application is still in my company's internal queue but based on the basis of my little experience, I would certainly not recommend them

With a due respect, I am differ with your statement on Competeamerica. Competeamerica has always promoted H1B and EB provision together. I haven't seen any time that they promoted only H1B.
I spoke with one guy at Competeamerica and he told me that IV is neutral on H1B issue eventhough all members have came through that root. Personally I am very positive with Competeamerica and it is not good for us to speak negative for this organization.

But I agree with Tito to some extent. Especially, if the degree is from even a slightly lower ranked school like Arizona or Northwestern, the returns are not there, and there is a great deal of evidence in that direction.

I have had this query before. I had an H1B stamping on my passport for a company I never worked for. (Company A)
But, when I applied for a H1B for a different company (Company B). My lawyer asked me if I ever worked for them and received any salary from them ... this was a RFE on my H1B case.
All I did was replied to my lawyer with a negative answer to both questions (worked, salary for Company A).
I got my new H1B approval I guess within 30 days of that RFE reply.
You might want to contact a lawyer to draft a reply to USCIS though. I do not have a copy of the letter to provide to you ... Sorry!

I think I know how this works. They would outsource this program to some govt contractor (or ask the govt contractor who is working on their data ) to produce that report which costs (<10$ worth of time/effort, if they have all the data).
If all they want is money ..so be it. I am ready to pony up $50 for this,if we all approach together. But as someone suggested country of chargability is a must.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

We can try but I have seen that it is not easy. I have tried calling a few friends but it is so hard to convince that the money is only going to help your cause. They will come up with every reason in the book to end the discussion. I am not saying that we should not try but you cannot help someone who doesn’t wants to get helped. what makes you think people participate in those? from personal experience
in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...

I am still trying to revive the chapter - some new members are active like laborchic and dressking and offcourse our Tri State volunteer team has always be trustworthy.
Once again - I know a lot of people do have genuine reasons and you must communicate.

I am an EB 3 with a PD of 2002 who has watched people substitute and get ahead, use creative lawyers and get GC's, i am stuck and will be stuck for a long time. My job is analytical so i have a habit of analyzing things. I am one of those who feel that the July fiasco created a mess for people who were already waiting, i also feel that the ad hoc FBI name check fix by USCIS screwed the large number of people who had cleared NC after the July bulletin (and missed that bus in the process). I am dealing with the hand that I was dealt.
I don’t have any animosity against the guys who benefitted by the above changes and have participated in all the phone campaigns, and will do so in the future. After so many years i feel that getting the GC is less of an issue for me (i never had problems in my home country, the only reason for waiting is that we have waited so long in the queue, why leave the queue now...sounds lame, but it’s the gods honest truth.)
I have seen many examples of each EB group to its own, realize this, we are all in this together and the only way of getting something done is doing something yourself. Do we have a choice..probably not..will desis be desis(or non desis for that matter)..yes most of them will be..it is what it is.
I know IV is doing its best and there are other groups fighting for HR 5882.
But honestly, what are the chances for this bill to succeed this year (before election)?

Ron Gotcher predicts that none of the individual bills may pass this year.
And also that EB3 I may not move forward even next year!
