    I finally received my I485 denial notice. I had to make 4 infopass appointments to get the letter. My attorney hasn't yet got it. I will be filing for MTR and sending the request to Ombudsman per another thread on this forum.


    Was curious if others have the following in their denial notice:

    last paragraph:"There is no appeal for this decision" This decision is without any prejudice to any future I485 application that you may file....blah blah.."

    They have quotedsection 245 immigration and nationality act [8 USC 12s5]..states " underlying visa petition upon which seek permanant residence has been revoked...blah blah"

    Is this pretty standard?

    I have a good experience with them. They have filed all my applications without unnecessary delays and they were also proactive in informing me about the visa bulletin reversal at the end of June.

    Sorry, I don't agree with you and also my mistake that I am linking my perm labor filing with Larrabee. I agree my perm labor is delayed because of my company.

    But I have seen Larrabee handling my h1B transfer case where they screw up by missing some document. Atleast by my experience I wound not suggest my company and Larrabee as well for any immigration stuff


    all our h1's transfers perm 140 got processed smoothly with larrabee...they worked all of friday and saturday to file 485's to reach by monday

    it all boils down to which attorney handles your case?

    Hello,
    I am frustrated that I have to pay for an attorney for a mistake USCIS did and concerned what will happen in future when I proceed with their advice.


    How about complaining to ombudsman about your situation?

    Thanks for posting 2007 cloture vote. So 53 senators voted in favor of 2007 CIR cloture. If even half of the following 15 Democratic Senators (who voted against the cloture vote) would have voted in favor of 2007 CIR, the bill would have passed the cloture vote, right?

    Look, I am merely saying that it is kind of an urban legend that Democrats support immigrants. But the fact of the matter is, that is entire false belief. And beware when Democrats take over the White House and the Congress in 2008. Legal skilled community is in for a very tough times ahead.

    Although, I must add, 2007 CIR was a death-trap for skilled legal community. It would have made life of skilled immigrants very difficult. But non of these 15 Democratic Senators voted against the bill because of this reason. Most of them were pandering to their base to make sure that they are re-elected. So it was good that the 2007 bill did not go through. These 15 men were in-effect our saviors from 2007 CIR :D

    I could not believe it either. My PD is August 2003 and EB3 from India. I have read many stories where people seem to have got GC when their PD is not current. In some cases, it appears they keep quiet about, but in some cases people seem to have corrected the situation to avoid any future complication, for example, if one decides to become U.S.Citizen at any point. It is just frustrating to think that I probably need to spend a lot of money on an attorney and go through the mental stress in resolving this because of probably an error some foolish clerk at USCIS made.

    Most countries do not have 9,800 EB applicants every year - in fact, most countries use well under 1,000.

    The total number of applicants from other countries can be derived from roughly estimating number if H1 holders, adjusting for Indians and Chinese, and then dividing by 2 (50% of H1Bs never end up getting a green card), and then multiplying by 2 to adjust for derivatives. The bottom line - there are visas available in EB2 ROW and EB1 categories (which are current, meaning, undersubscribed), that are getting redistributed to EB3 ROW. This is why EB3 in total is using more than its share of 140,000 EBs. In fact, I believe the dates will be moving pretty fast on EB3 ROW, it will probably get all current in a couple of years.

    55 % were issued for workers from just the five countries of India, China, South Korea, Philippines, and Mexico.

    Prince,

    I am sure it could be a mistake from CIS, you should be fine after your MTR submission.

    I myself changed employer after 180 days, I am working for second employer now after my GC sopnsered employer. I have not informed CIS yet, planning to do now as I got kind of good and stable job and company.

    Initinally after 180 days I have joined a small consulting company and working for a client and then after some time client offered a fulltime employment with same titile and responsibilties. I have joined the client and willing to send AC21 letter now, anybody any sugessions would help me here.

    Hey guys

    Just received email from CRIS regarding I-485 denial notice for both me and my wife.

    I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.

    My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.

    My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.

    This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.

    Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

    H1b Transfer from IT to Marketing.

    Hello All,

    First THANKS to all for the fantastic information and help on this forum !

    I have a H1 B based on IT ( Software Engineer).
    I have already completed 6 years in the US, but I have three year extension till 2010 based on my labour pending for over 1 year.

    I am not very keen about Green Card - But I wanted to change my job to Marketing for an insurance company (better pay and it is a role I like).

    My questions are :

    1) Can I transfer my H1 to do Markeing for the insurance company ( the job profiles are going to be different as my current job is in software) ?

    2) Since I am on a three year extension based on my current Labor will it be an issue to transfer to the new company ? ( The new company is willing to transfer but is not willing to file a new H1).

    Your advice is much appreciated.

    What we get

    1. We get number of EB2,EB3 Primary and EB2,EB3 Dependent applications.

    2. From the wordings, I won't be suprized if they give a summarized number from 2001.

    But if someone else requested this info broken into PD buckets by month and Year, then I think we need to use that. The letter I sent had that wording, but I never received any response yet.

    Here is what we don't get

    1. Break up by country - Helps folks in EB3 as ROW is not current

    2. Some might have not applied for AOS for various reason like their I140 is still pending, Some companies mandate that. - This could be a small percentage

    3. Break-up by PD month& year

    More insight is welcome.. Pre-adjudicated cases are not approved cases. So they can't eliminate them..

    Hi,

    I lost my jon w/big software consultancy. I found another project and then applied for H1-B transfer with Indian consulting company. Its been almost 1 month since new company have filed for H1-B transfer and renewal (my H1-B was expring on July 6th, 2009).

    so far, i've not received any H1-B recipt. I'm worried about it. I'm also getting married in the last w/e of Nov, 2009. Is it a good idea to file for Premimum processing.

    please be so kind and explain me what exactly shall I say to the SSN Office about why I apply for SSN non-work. If they ask me to proof that I need a SSN to get Economic Stimulus Payment, what shell I do??
    How is posible to get a SSN non-work to get Economic Stimulus Payment if you didn't work. How can you make tax return without to work. ?? Sorry for all this question but I really don't understand. But i'm shure that you will be very nice and you will explain me how it's work.

    its very simple and doesnot take more time. I was working from home today so called few lawmakers including Rep Smith and Rep Rothaman. Lady took address and phone no and told me she will pass a message and let me know via mail.

    Please call . These bills are only our hope till next year..
