Since this bill has EB based provisions and does not have controversial guest workers program, would it make more sense to support this bill if it were to be tabled on senate floor instead of Specter's bill? Especially since house is totally opposed to any bill which has a guest worker program.
Moderators and those involved with IV's lobbying firm give it a thought as this bill will be less controversial than specter's.

Hi,
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.
Here are my questions.
1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?
2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.
3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.
4. Anyother suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.
Thanks in advance.

For a change - at least it feels like someone is listening and that I am doing something for a change in my situation.
I have asked people (my friends and office colleagues (Americans and non-Americans included)) to call the Congressman's office and express support. I am sure at least 10% of the people whom I spoke to will be calling the Congressman's office.
Go IV!!!

I had been there in US for 7 yrs (3 yrs in L2->1yr out of US->4 Yrs in H1B). Saw the myths and tragedy of US GC process very closely. Didn't want to spoil peace of life and my hard earned money with USCIS and lawyers:mad:. Didnt look at the US GC application and applied for Canadian PR. Came to Canada with PR last year from US. Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE. enough. I am not going back to US even for a visit in next 5 yrs..
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D
To those who are portraying wrong picture of Canada, all I can say, if you have skills, personality and capability, youll succeed anywhere in this world, be it in US, Canada or Australia. Dont blame it on a country, but look at yourself.
Just my 2 cents.
Hello PAL, You are 100% right - here is my full support to your argument !!

Well, I hope mine gets resolved sooner than 6-8 months! My EAD is already expired and I could not apply since there was nothing in the application where I could show my status which is PR.
TravInd, you are right about people not knowing the priority dates and not aware the GC was a mistake. In fact, I still don't know for sure if mine was a mistake. I will know only when I find it out through the lawyer. My previous lawyer who worked on my GC case said congratulations and everything was fine. I am eager to find out if it was a mistake on my own.
Just a hypothetical scenario.
Say an applicant is having PD of March 2005.
His/Her 485 gets approved with PD of Jan 2005. (may be a typo by CIS data entry person)
However at the time of approval, PD is current till June 2005. (he or she should have been approved anyway).
What would be the scenario? Thoughts? Any one????

Hey guys,
I am planning to take Infopass to see what more information i can collect.
Also does anybody know if USCIS send courtesy copy of Denial Notice to you as well.
My concern is that my attorney sent G-28 and AC21 both but he feel that since I-485 got denied means they have never updated G-28 or AC21 so it might go to my old attorney.
Does anyone know if i will get courtesy copy of denial notice?
Thanks

Its very disappointing to me. My some of friends who filed labor just 2 months before me now will go citizenship for next year.
All EB3 who filed their I140/I485 in June and afterwards have to wait till processing date cross at least June. Right now TSC is processing April 2007 cases. I believe when both center starts processing July cases then you can see significant movement in EB3 cases. I think you need to wait till September when new quota comes. Till that time as my Atorney says focus and save your Jobs. Get more skill. Without good job all above is meaning less. Busy yourself in NFL, NBA, NHL or Cricket be cool and calm. Nothing is in your hand except waiting.

I'm so reliefed and excited to see the bulletin site after so many years...
At first it look like a prank to me, like what happened last month.
But now I 'm quite certain that that yes the dates did moved for EB2 category upto Oct-01-2005.
Its really a great great news after a long long time !!
Someday I will also complete my journey :)

Nicely put paskal.
Let's do something (call Senators, Representatives, lobby) and put our collective strength behind getting those 200000 unused visas. RECAPTURE is the mantra .
you must know something i don't.
aman kapoor is the president and founder of iv- of course you can argue he now has his GC but that fact is he is still the heart and soul of iv and runs the organization on a day to day basis. he is EB3.
the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)
no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!
so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.
where were you when USCIS implemented vertical spillover in 2006 and left EB2 I in a U state while giving EB2 Gc numbers to EB3 ROW?
did you object then? did you start a campaign? did EB2 I folks here start saying that iv did not care about them?
in 2007 ordinarily, (like 06) EB2 I and EB3 I would have got only 2,800 GC each. because of iv's efforts in reversing the july bulletin, EB3 I got a huge number of Gc instead. many more than any other category. i don't remember anyone else standing up and saying that this was unfair and that iv is all about EB3I. and that's what a lot of anti iv folks say. that iv is all about EB3 India. so this is very ironical.
and i see here a comment that every campaign has been bad for EB3 india.
i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.
you opened my eyes :-)

This is what Fragomen says but we have to keep our fingers crossed:

Proposed Amendments to the Senate Bill
Late last week, Senators Maria Cantwell (D-WA), John Cornyn (R-TX), Patrick Leahy (D-VT) and Orrin Hatch (R-UT) announced an amendment to the Senate bill that would make important changes to several of the employment-related provisions of the Senate bill. With respect to immigrant visas, the amendment would restructure the proposed merit-based program to add several of the features of the current employment-based system. The amendment would add an employer sponsorship component, and would create programs equivalent to the first, second and third employment-based preference categories for foreign nationals of extraordinary ability, outstanding professors and researchers, multinational executives and managers, advanced degree professionals, foreign nationals of exceptional ability, and professional workers (though the amendment would not provide for an equivalent to the current "other worker" subcategory). The amendment would also restore the labor certification requirement for the second and third employment-based preference categories, but would not provide for a national interest waiver of the requirement. In addition, the amendment proposes an additional 140,000 immigrant visa numbers for employer-sponsored merit immigrants, and would create a quota exemption for certain highly skilled immigrants who have at least three years of U.S. work experience. Regarding the H-1B program, the amendment would eliminate the 20,000 ceiling on cap exemptions for foreign nationals holding advanced degrees from U.S. universities and create a new exemption for foreign nationals holding foreign advanced degrees in the sciences, technology, engineering or mathematics. The amendment would also dispense with the Senate bill's expansion of the recruitment and non-displacement attestation requirement to all H-1B employers.

This wud sound like good news except for the word "introduced". The SKIL bill was "Introduced" in the Senate as well. I would love to go "ra-ra sis boom ba" on this peice of news, but history shows that a lot of bills get "introduced" but remain on the senate/house back burners. This is good news but let's be cautiously optimistic/enthusiastic.

Will advanced degree holder need labor certification?
I think they will. Here is how the new labor certification clause will read:
(5) Labor certification and qualifications for certain immigrants.-
(A) Labor certification.-
(i) In general.-Any alien who seeks to enter the United States for the purpose of performing skilled or unskilled labor is inadmissible, unless the Secretary of Labor has determined and certified to the Secretary of State and the Attorney General that-
(I) there are not sufficient workers who are able, willing, qualified (or equally qualified in the case of an alien described in clause (ii)) and available at the time of application for a visa and admission to the United States and at the place where the alien is to perform such skilled or unskilled labor,
(ii) Certain aliens subject to special rule.-For purposes of clause (i)(I), an alien described in this clause is an alien who-
(I) is a member of the teaching profession
(II) has exceptional ability in the sciences or the arts; or
(III) has an advanced degree in the sciences, technology, engineering, or mathematics from an accredited university in the United States and is employed in a field related to such degree.
Source: Official Senator Frist's Bill http://thomas.loc.gov/cgi-bin/query/F?c109:1:./temp/~c109BRbYkn:e244507:
INA Act 212 http://uscis.gov/lpBin/lpext.dll/inserts/slb/slb-1/slb-20/slb-2112?f=templates&fn=document-frame.htm
So labor certification is required for advanced degree holder in STEM with 3 years of US experience prior to applying will be treated as special a case.
Also, this clause says that the degree has to be from a US university. I think Attorney Mathew Oh is wrong in saying that graduate degree holders in STEM from foreign universities can apply too.

But Indian guys working here are third class fellows.
Arrogant, low tendencies, flase values etc.
They don't even mix with other Indians and think they are in Heaven or some thing.Don't worry if they loose their GCc.
These guys are unworthy of gettings GCs.
