You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.
PhD is no trivial thing. One does a phd only if one is truly motivated.
Plus PhD doesn't guarantee EB1 either.
Since 2001 downturn PhD graduates are having a hard time getting faculty positions
as education budgets haven't increased much and therefore faculty positions are very hard to get unless you are from a top school like UIUC, Stanford etc.
You will have to do 1-2 years of post doc at 30K per annum salary to land a
faculty position.
So you are looking at 6 (phd) years + 2 (post doc)years to land a job as faculty
and after that it might take1 years to get GC.
Living on 6 years of 18K per annum salary(Phd) + 2 years of 30K per annum salary (post doc) is no easy.

Inspite of this rumor, they sent us urgent email, that they are working overnight this weekend and if possible they wud like to dispatch our 485 papers before saturday noon for Monday am delivery at uscis. We were impressed. They even didnt asked for the attorney fees in this moment , we just submitted the filing fees.

A lot of lawyers who are really committed and sincere to their client's clause: Getting them Green Card, are working overnight and over the weekend also so that their client can file I-485 ASAP and on the other hand few law firms are acting as slackers and not even responding to their client's emails.

Nola, your intentions are good, but I do not agree with your conclusion. You are biased against yourself and other applicants.

2. also, if someone goes thru' "pain of gc revocation" due to cis error, isn't it ethical (and legally required) to provide "ead/ap" (so person can continue to work and feed his family, be in status), "reinstatement of (again) pending 485" etc. to that person by cis?

I understand what you are saying. Both, the applicant (or applicant's attorney) and CIS shold follow the correct procedure. However, there should be no elation to getting a GC when the PD is not current, hence there should be no distress for its "revocation" - which again is a matter of semantics, there is no GC, hence there is no revocation.
I commented on what the applicant and the applicant's attorney should do based on what is ethically and legally appropriate. I did not comment on what USCIS may or may not do to resolve such a situation.
I understand the struggle you metion; I have been in the US since 1994, i lost my priority date of Aug 2002 due to impatience with the backlog center. I started my GC process in 2001! I had a job loss due to Hurricane Katrina. I am married to a US Citizen, but cannot get sponsorship from that marriage due to DOMA. The pity list goes on and on for each and everyone of us. So believe, me, i understand the aspect of "struggle" that each of us has had to endure or is still enduring in order to get a GC.
I don't see how I am biased, especially against myself - that doesn't make sense. I am not an attorney, obviously, but i work very closely with attorneys, well it is essentially my job to work with them and the bottom line in every contractual arranagement or when applying the law, comes down to what are the obligations of the entities involved whether it is a contract or the practical application of the law.

My company does not allow us to pay for our own labor. It is against the law. My company was not doing new perm labors for people who had already applied in regular processing.
Coming to present situation, my company attorneys are so overloaded with labor work that they have become very slow in responding. Now it will be even worse since everybody will be applying for 485. I feel they have created a choas.
Look, i sympathize with you but you SHOULD HAVE poured in some money to start a parallel PERM application ..... PERM started from APR 2005 - you got almost 2 years +

When I got laid off, my lawyer at the time told me that technically you are out of status as soon as you leave payroll. There was no such thing as a "grace period". I was advised to change my visa status to B2 (I think it was that) with immediate effect, if I could not find a new job within 2 weeks to complete an H1B "transfer". It isn't exactly a transfer of the visa, but what you would do normally when you are changing employers whilst on H1 B. I was told that the "maintaining status" was verified by payroll dates, so within the 2 weeks (I was paid bi-monthly) would be safest

The problem here is not 5000 dollars. The problem here is that the situation is hopeless because they dont assign country of chargeability to pending 485 cases up until they are ready to approve them, if I read it correctly. The data that is not captured is the data that cannot be queried, simple as that.

After watching Senator Kennedy say that the "highly skilled" are adequately taken care of under the H1-B program and thus that there is no need to work on EB amendments, then watching Bernie Sanders have his anti-H1 amendment passed under the guise of a scholarship program not to mention his claim that H1 workers replace laid off American workers, and to have Dorgan (the master of the poison pill amendment that probably killed the bill "for now") rail against the H1 program while constantly complaining that "fruit of the loom" underwear is no longer made in the USA and to see Senator Ensign's effort to reform the merit system to give high skilled workers more points shot down, one can safely conclude we have little chance attaching provisions for our cause to other bills. Any attempt to try to pass pro-legal legislation will likely meet strong opposition from the pro-undocumented lobby, not to mention the propaganda disseminated by NumbersUSA, Alipac and Co., IEEE etc etc who have managed to sneak in their provisions into CIR. Unless we can lobby stronger and dispel the myths perpetuated by these groups we face a very uphill battle. Recently these groups have been quoting a Tata executive saying that they pay their H1 workers lower wages than an American would receive. When the pro-legal immigrant groups fail to counter these accusations or fails to deny them, then they become accepted and give leeway to restrictionists to accept them as fact when they are not.

My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

bigboy.. We need about 20 volunteers per state to pledge 200 letters each. It is achievable. But 20 volunteers is far from reality. That is our challenge.
Friends Please dont jump on me as i make these comments. I am doing my best to convince ppl as i see across to Join IV and contribute to our efforts. But i also think that every state chapter should allocate some members who only concentrate on grass root efforts but nothing else to track how many memberships and etc and those should co-ordinate with every state to see how much they can target and how much did they reach. I know this might have been thought by some others but just what i am thinking ?

If its a transfer, your I-94 "number" will be same. Check to see if you have same I-94 number on any or all or atleast 2 of your I-94's including the one which they provided you at POE "across" any of your employers (1, 2 and X).
You can also check the application receipt date on them.. see if they are around April of those years? Most probably they will be new filings if the receipt date is around April oppose to September or November.

This will sink both of them unless either there is some inside deal going on that we dont know, or they strike out the H1 issue from this on the floor of the senate at the last minute and be content with H1 quota of 180,000.
I don't understand the risk you are mentioning. How unlimited H1B is going to cause problem in eliminating retrogression in EB catagories?

I really admire that. I feel I missed out on all the satisfaction you get when you are proactive about something.
