    This is what i understand

    1.Advanced Degree-(where most of us fall into ) it is either masters or Bachelors+5 years

    2.Exceptional Ability- Assume a guy who has a diploma or a 3 year degree with some certifications.In a normal scenerio he would apply for EB3.But this opens up the scope for him to apply in EB2 also provided he satisfies a 10 year experience and any other stuff from the criteria below...

    Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability
    Letters documenting at least 10 years of full-time experience in your occupation
    A license to practice your profession or certification for your profession or occupation

    I think priority date is important only for using a visa number for a 485 application which has been adjudicated. What is the use of a 485 application pending processing even if the visa numbers are available for that PD.

Civil disobidience is a tool of the citizens..In my opinions we would get more negative publicity if we go around picketing..First of all all of us are above the average income of a standard working class American family.     I believe this is a very valuable debate/query and unfortunately there is no certain answer for this, there are numerous reasons either ways.....

    I am sure to go back to my Home country - my reason is bring up of my children.

    Ooops, i missed this in my original post. This is true for Nebraska service centre.
    I am not sure about the other service centre. Sorry dudes.
    This is great first step! Many more to cross over! :) . Think about the USPS or other carrier who will be delivering these tons of letters.. I hope the mountain of receipts will not be a overwhelming factor for them.

    This scenarios is for those who used all 6 years on H1 and got H1 extension due to a pending AOS application. they may have EADs too..

    Ron Gocher quotes:
    "Again, to be clear, my point is that if your AOS is denied, you immediately lose all eligibility for post sixth year extensions of H status. All time spent in H status counts against the six year limit. If you burn up time in H status while you are waiting for an AOS adjudication, you may well make it impossible to go back into H status if your AOS is denied."

    My interpret...

    Rule 1 :

    > The max limit for H1 is only 6 years.

    > You can only extend H1 beyond 6 years if there is a pending AOS
    this means if there is no pending AOS, u r not eligible for H1.

    On thing is clear, if AOS denial is valid, then thats it, no more H1 (after 6yrs)

    but surprisingly Ron doesnt use the same logic for EAD too.

    > EAD is also given as a temp relief for those who has pending AOS
    so if there is no pending AOS, no more EAD too.

    he thinks EAD is valid even after AOS valid Denial.


    THe BIG QUESTION is, If AOS is wrongly denied and MTR is open,

    What is the status of the dude?

    Is the status AOS, coz its been denied already...

    But again, if the dude's out of status due to AOS denial,
    how come CIS allow to file MTR? Coz they know the guy who is
    filing MTR is out-of-status due to AOS denial :-)

    Its like a software u tested a lot with all kind of scenarios,
    but there is one scenario still not tested.

    Like in software, the dudes who initially wrote the code and the dudes who initially spcified requirements, are long gone to a different jobs. and after a few years (5,10 etc), a new set of dudes trying to wonder why this scenarios is missed, coz the whole biz process is already changed totally.

    so, the dudes who wrote these rules and regulations are long gone and retired. and there are hell lot of things changed afterwards like AC21 etc etc.

    thats is why systems need to be re-evaluated in a regular basis.

    Hello, I have been through the same situation for past 2 years. Just carry your receipt for extension to the local MVC and they will give you 3-month extension on your licence. During that course, your actual extension should arrive upon which you will have to renew your licence. It's better to spend $24 for licence renewal that spending $1000 for premium processing.

    My H1 extension is under process. I had applied in Dec 2006. My DL expires on May 6. Is it possible to renew my license with the H1 extension receipt?. Is it possible to do Premium Processing now?

    Just remember.. if we are not united, we ain't getting nothing. Lets work on Recapture of wasted numbers. Thats the only inflow we can rely on. We don't have to wait for their charity every month in the name of left over numbers or spill over numbers. We want our legal GCs. We worked hard to earn it. Lets stay united and fight against the system.
