I know i keep bumping this thread but I am surprised that no one has posted any experiences regarding the AP. I mean i see a TON of stuff about EAD renewals but nothing specifically about the AP. I guess ppl are more interested in making money than leaving the country (like ME ;) )

The target is 1000. IV core group is not asking for funds now because we have done all we could to make our case and we have reached a ceiling. Now, it has to come from the heart of the members and if they feel we are doing the right thing they will contribute. We had all kinds of nasty posts whenever we /members started asking for contributions. Yes it will help when you call your friends. No we dont have phone numbers. Only few people put their phone numbers in their profiles. most register annonymously and a lot of nasty posts come from such members. Despite repeated requests most members have not updated their profile with contact information.

I don't understand the confusion. Didn't Ron mention in an earlier post that the DoS guy who makes cutoff decisions said that all new EB-2 India visas will only come from EB-1 unused numbers?

You'd certainly find the poetic notion in the constitution that "all men are created equal" but if the purpose of the US government and its agencies didn't allow them to balance this with protecting the interests of the US public, a billion people from around the world would move in tomorrow. By your logic, an illegal or one with visitor visa would apply to a job he's qualified to here then sue USCIS because their stupid rules that do do not treat him equally like all other men cost him the job.. Congress enacted the INA (Immigration and Naturalization Act) and tasked USCIS to enforce it.. I researched Title VII and the INA in my paper (so much fine print than the highlights u mentioned) and can tell you that title VII specifically allows INA to override it in matters relating to Immigration, and in many cases INA obliges and in many cases walks all over the EEO and all men equal concepts.. as i discussed with my employment law professor who had a good background in immigration, the situation can't be changed without rewriting Title VII and the INA..
Anyway, just my professor's opinion and mine, u have every right to disagree but plz let's do something instead of talking..

I therefore believe there is a good chance at the Supreme Court ruling that because of long wait times of more than 3 years for a Green Card plus requirement of same or similar job during that long wait until the green card is received plus country quota affecting people born only in few countries leads to disadvantage for people of these few countries at work.
And yes, even I took law course and gave a seminar during my MBA. But even you would concur that this course at best is basic and does not make a person authority of the US legal system.
Finally, forget me or you, even a lawyer cannot say for sure what the final ruling will be in any case. And hence the best a person can do is give an educated opinion. In addition by human nature, the way I would interpret laws would be to my advantage while the way you would interpret them would be to your advantage. And hence I can understand your biases (and mine as well) because in case the country quota is found illegal by the US Supreme Court, it is the ROW that is going to be affected the most.

I am not sure whether my employer will provide the check copies for 140 filing but yeah I have the Fedex Tracking number which shows 140 delievered on 16th July.

Hello IV members,
First I want to congratulate all the IV members who worked really hard to make this rally a success.Unfortunately I couldn't able to attend the rally.but I have contributed $100 for the rally.I think it is a good idea to make rallies in all the major cities on same day and show our strength.Head count matters in grabing the media attention.
I live in sunnyvale,CA and i'm interested in meeting the local IV members in person this week end to discuss further course of action.I will put 100% efforts to give my best for this cause.

I have a my my case in pending state for H1B transfer from company A to company B.
Pending status h1b with company B.
From Company A : I got the Labor and I140 Approved.
I m trying to file my 485 through comapany A- But my employer says that I need to have new H1B with him- Cos his company merged with another another company.
Can someone try to help me on it:(
H1 and green card are seprate things. H1 is for current employement and green card is for future. If down teh line you can come back to employer A you should be fine. Although all this can generate a RFE. Please consult a lawyer. I recommend Rajiv.

i think it's not quite that simple.
there is no doubt that lack of numbers is a key key issue. but letting uscis off the hook when they have failed to process 269,000 Green Card numbers since 1994 is not kosher. that is >20% of the backlog right there.
my straightforward NIW application based on national interest service not exceptional ability (which may be more subjective) will take almost a year to process. wow....!
uscis also takes the narrowest interpretations of any law- even when it clearly conflicts with the law's intent- then it takes a lawsuit to budge them- speaking from personal experience and the loss of 4 years in PD in an India line...believe me this is not an agency i feel like defending.

Hey, mine is EB2 ROW - can't get any more straightforward than that, I-140 is approved, and PD has always been current! Well, 1 year 7 month and still counting. It would be really easy for me to blame USCIS inefficiencies, but let's look at the whole picture. My second H1 was approved in 1 day (premium processing), my I-140 was approved in 9 days (not premuim processing), I got my fingerprint notice and RFE on I-485 a month after I applied - that means the case was looked at, determined what else they needed, and everything was processed. Work on my AOS case was over 4 month after applying (and I did apply concurrently). Then, I had to wait for namecheck... and wait and wait. Do I blame the processing center for that? No, it's not their fault. Do I blame Chertoff for that? Sure! He is the one who's supposed to negotiate things between DHS and FBI, and make sure things work well together.
Now, we come to a different issue - quotas. It is obvious that USCIS is not good at all at managing quotas. I am in management, and to me the task of getting within 100-200 approvals on 140,000 quota does not appear Herculean. It's a very predictive process, so theoretically it should be easy to get to right numbers. My take - USCIS system is built in a way that does not allow them to understand and manage the flow of petitions - and forecast how many will be ready for approval in any given month. That's a big flaw, but you know what is the best way to fix it - to relax quotas. Then, they would not have to triple-check every petition to make sure it's current and it is its time to be approved. Having quotas adds a lot of complexity that CIS can't manage. If you look at the immediate family petitions, that do not have quotas, they are getting approved in 3-4 month, so one part of the system works fine, and the other does not.

In this big black hole we are alone, not the govt. nor the lawyers really care for what goes with us. USCIS is just a money making machine for the govt. Rules are made complex and there are several layers of forms. I wonder why a person should go thru 2 stages before filing for I-485. Or why they have 5 different forms filled Labor/I-140/I-485/I-760/I-131 blah blah blah when they could just do it with 1 form like any other country have or may be 2 layers, labor and I-1485. There's no logic of having to file I-140/I-760/I-131. It's all money game...
AILA does not care about people its an organization to take care of lawyer's interest. When you file every year the lawyer can make money every year. So be rest assured they will make some noises but will not bite USCIS.

I'm guessing if its contractors/workers, its likely to come out of EB category. This is bad news! They should have additional numbers for these situations rather than taking from existing pool which is already retrogressed.:mad:

First of all their tickets are way too pricy. People pay shit load of money and get treated like a dogs?? We have choice no matter where u fly from. Try to avoid these European carriers. Try to fly Asian or Indian carriers.
Air France needs to learn that everybody is a customer, irrespective of their skin color/race. And every customer is entitled to same service as rest of them.
