Don't even touch them with a stick. Their services stink.. and they pose as acting ethically but walk a fine line while representing you. They have consistently advised companies ( unfortunately some of the Big fortune 500 one's as well) about how to slow down the process of immigration and have them use it as a retention tool. They advised my previous employer that my job profile did not meet the EB-2 requirements as I was in professional services...! Every one that I hire has a masters and even the client locations that I work at, you did not find any one with my skill set who could not qualify for EB-2. They advised my company to file uned EB-3 to be on the safe side and that too non RIR. I was told that even the position of CEO does not require a a EB-2 qualification and that since about 200 people were laid off 2 years back in acompany that has 9000 employees, my RIR application would be denied. This happened with the Fragomen office out of Dallas in the year 2002. I hope they have improved since.
I was smart enough to say bye to that company and join another fortune company that does not have Fragoment as their lawyers. (I checked on that before I joined them).
I would urge tech industry employees to write to thrir HR departments and their V.P's about this widely used practice at Fragomen and that their representation of the case is not dual. They have acted as black sheep on other cases I know of in simiular situations.

My wife was on H4 before and since Oct 2007 she started working on H1. Since we haven�t had a chance to go to our home country, her H1 is not yet stamped. She is thinking of switching to some other company. Can she transfer her H1 without having a stamp?

I met a US citizen to whom I explained the situation. She immediately signed this letter and asked for a soft copy and is going to get all her friends to sign it. If people who have nothing to gain can help out so much, surely we can do better.

Please stop posting such rude and derogatory posts for people stuck at BECs. It's very easy to criticize if you are in a better position than someone. But remember, you could also have been one among them. Then, if you were expressing your dissatisfaction and instead have people call you losers, you wouldn't begin to imagine how that feels. Are we/employees really supposed to know all the steps involved in the approval of GC process (Perm, 140/EAD/485 etc.)?
I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They don�t pay from their pocket for GC (ideally correct). None of them has clue about priority date etc�.they get communicated by the HR department about their GC process.
So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.
Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I don�t think so but some one can confirm if they had experience otherwise.

Not to dismiss your thoughts on this thread but lets move on and use your experience in guiding newer folks on this site in better helping our common cause.
We have seen a tremendous response to the Omnibus drive and with a collective effort we should be in a position to help the EB immigration situation.

Under the Fees section, it stated that if you filed your I485 on or after July 2007, and you paid the I485 fees, then no fees is required. Does that mean that I don't have to pay for the $305 for my advanced parole?
My I485 was received sept 2007, and I paid for the I485 fees, offcourse. This is something that I'm not too sure.
The filers who ever filed in July 2007 to August 15 2007 need to pay Advance parole money also.

I want to see action too, but with 100 members scattered all across texas, it just doesn't make sense.
Even in flower campaign a few brave ones bore the burden, the rest were watching. For any action that IV leadership picks, how can we ensure success if we don't get the commitment of members?
By joining your state chapter you are making that commitment that you are willing to be contacted by IV, and willing to stand by the organization in the hour of action.
If you are already a member, convince a friend to do the same. This organization needs committed members. We are not asking you to have to volunteer five hours a week, but when its D-Day, are you willing you stand up?

We can file in Court if required as a Group to get a greater exposure and success.

That is exactly what I am thinking. There are laws to protect immigrants from discrimination. I believe this clause was added to the Social Security Act to protect us in situations exactly like this one.
Also, I am glad to have become involved in this as it has led me to great immigration resources like IV, which I would not have known about otherwise.

Still puzzled and wondering why they would ask about PD.
Is this something we have to fill out on the AOS application?
I know it is not always the labor filing date, it can be the I-140 filing date if someone didn't require labor cert.
But, do we fill this date out on 485 app and is it entered into their system?

I think you will have some benefit out of this bill, albeit, indirectly. This Bill will exempt a lot of folks with advanced degrees from US and non-US universities. All advanced degree holders from US univs. (STEM and non-STEM) will be exempt. So, a person with an MBA flus a 4 year bachelors from a US univ. will be exempt. Also, folks with non-US STEM advanced degrees who have been working in the US in a related field for 3 or more years will be exempt as well. The family members of such folks are exempt as well. Consequently a lot of folks currently waiting in the pipeline may no longer be counted against the quota, thus reducing the clog in the pipeline. ANother benefit out of this bill is that it increases the quota from 140K to 290K. There fore, you will definitely see some positive movement in priority dates for people in your and other similar situations (this is the indirect benefit I was referring to). It is very hard to say at this point how much the positive movement would me. It will all depend on how many people will be exempt from the quota.

I am actually curious about peoples reasoning behind not attending the rally. I don't think anyone should judge people's decisions, but if we can understand why we didn't succeed in tempting you to come, we can learn for next time.
It sounds like you might be considering going to another county or back home? Ironically, if this is true, it highlights perfectly what one of our key messages was at the rally.
You are a poster child of reverse brain drain. The US needs to keep talent, whether it is home grown or imported. By making the process so grueling, people are starting to leave in droves.
I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.
I did paid 50% travel cost to one of our member from CA.
Sorry for not attending this time, will do it next time.
